Terms and Conditions

Welcome to Divvia Photo Booths!

1. Agreement

By booking a photo booth rental or any rental with Divvia Photo Booths, you (the client) agree to be bound by these Terms and Conditions. It is your responsibility to read and understand them fully before confirming your reservation.

2. Booking and Payment

  • If not Paid in Full. A non-refundable down payment of 20% of the total service fee is required to secure your date and photo booth rental.

  • The remaining balance must be paid in full no later than 6 Days prior to the event date. Failure to pay the remaining balance by the due date may result in cancellation of the booking.

  • Any additional hours requested on the day of the event will incur an extra fee and must be paid prior to extending the service.

3. Cancellation Policy

  • If cancellation is made within 2 Days of the event, the full rental amount will be charged.

  • In the event that Divvia Photo Booths must cancel due to unforeseen circumstances (e.g., equipment failure, emergency), a full refund will be provided, or we will work with you to reschedule the event.

  • Once the estimate/Agreement has been accepted, any requests to modify the package by removing items or downgrading services will only be eligible for a 50% refund of the removed item's value. This policy is in place because, upon accepting your booking, we reserved those items and services exclusively for your event, potentially turning away other clients who inquired about the same date. This ensures fairness and allows us to manage our availability effectively for all customers.

4. Event Location and Requirements

  • The client is responsible for ensuring the event location provides a suitable space for the setup of the photo booth, which includes adequate power supply and access to WiFi for photo sharing and booth functionality. A minimum of 10'x10' Area is required for our photo Booth.

  • If the WiFi at the event location is unavailable or unreliable, preventing the photo booth from operating as it should, a $75 add-on fee will be charged for using our portable hotspot to ensure proper functionality.

  • The location must be level, dry, and protected from adverse weather conditions. Not directly exposed to sunlight rays.

  • Any delays or issues arising from unsuitable conditions at the event venue will not result in a refund.

5. Equipment and Setup

  • Our attendant will handle all setup and breakdown of the booth.

  • The client is responsible for ensuring that the booth and equipment are not damaged during the event. This includes loss of Event Props. Any damage caused to the equipment due to negligence or misuse by the client or guests will result in charges for repair or replacement.

6. Operation Time

  • Divvia Photo Booths is not responsible for any loss of operation time caused by venue-related issues, such as power outages or other unforeseen problems outside of our control.

7. Photo Usage

  • By booking our photo booth services, the client agrees that Divvia Photo Booths may use event photos for marketing and promotional purposes. If you prefer not to have your photos used for these purposes, please notify us in writing prior to the event.

  • Photos taken during the event will be provided to the client either in print or digital formats, or both, as specified in the package.

8. Liability

  • Divvia Photo Booths will not be held responsible for any injury, loss, or damage resulting from the use of the photo booth or the actions of guests during the event.

  • The client agrees to indemnify and hold harmless Divvia Photo Booths from any claims related to the event, including but not limited to injury, damage to property, or loss.

9. Force Majeure

  • Divvia Photo Booths is not responsible for any failure to perform its obligations due to unforeseen circumstances such as natural disasters, power failures, or any event beyond our control.

10. Additional Services and Subcontracting

  • If the client requests additional services beyond photo booth rentals, such as DJ services, Bartending Services or other entertainment options, Divvia Photo Booths may subcontract third-party vendors to fulfill these requests. While these services are provided under Divvia Photo Booths, the client acknowledges that the actual service may be performed by a third-party subcontractor.

  • Divvia Photo Booths will ensure that all subcontracted services meet the same quality and standards as our own. However, any issues or claims related to the performance of these subcontracted services must be directed to Divvia Photo Booths, and we will work with the subcontractor to address the concern.

  • The client agrees that Divvia Photo Booths is not liable for any damages, delays, or failure to perform by subcontracted vendors due to unforeseen circumstances beyond our control, such as equipment failure, illness, or other emergencies.

11. Changes to Terms and Condition

  • Divvia Photo Booths reserves the right to update or modify these Terms and Conditions at any time without prior notice. It is your responsibility to review these terms regularly.

By completing the booking and submitting the deposit, you confirm that you have read, understood, and agree to these Terms and Conditions.

Rose Wall Rental Terms & Conditions

1. Delivery & Setup

  • Divvia Photo Booths will deliver and install the rose wall 1.5 hours prior to the scheduled event start time.

  • The renter must ensure that the designated setup area is clear, level, and accessible upon arrival. If the area is not prepared, delays may occur, and additional fees may apply.

  • The rose wall requires a minimum space of 9 feet (width) by 2 feet (depth) to ensure proper placement.

  • Once installed, the rose wall may not be moved, adjusted, or relocated by the renter or event attendees.

2. Pickup & Post-Event Procedures

  • The rose wall will be retrieved the same day, either at the venues designated teardown time or immediately following the conclusion of the event.

  • The renter is responsible for ensuring that unobstructed access is provided at the scheduled pickup time. Delays in retrieval may result in additional charges.

3. Usage, Care & Damage Policy

  • The rose wall must be maintained in the same condition as received.

  • Decorations, adhesives, pins, tape, or any foreign objects may not be attached to the rose wall without explicit prior approval from Divvia Photo Booths.

  • The renter is fully responsible for any stains, tears, structural damage, missing floral elements, or other alterations to the rose wall during the rental period. Any such damage will incur repair or replacement fees at the discretion of Divvia Photo Booths.

4. Outdoor Use & Weather Restrictions

  • Outdoor use of the rose wall is not permitted unless explicitly authorized by Divvia Photo Booths.

  • If approved for outdoor use, the rose wall must be placed in a covered and well-protected area to prevent exposure to rain, wind, excessive sunlight, or other potentially damaging conditions.

  • If unforeseen weather conditions arise, Divvia Photo Booths reserves the right to deny or remove the setup without refund to prevent damage to the rental item.

5. Liability & Indemnification

  • Divvia Photo Booths is not liable for any injuries, accidents, or damages arising from the use of the rose wall during the rental period.

  • The renter assumes full responsibility for ensuring that guests, event staff, or attendees do not lean on, climb, or tamper with the rose wall.

  • In the event that the rose wall is knocked over, damaged, or causes injury due to guest negligence, Divvia Photo Booths bears no liability.

  • The renter agrees to fully indemnify and hold harmless Divvia Photo Booths from any claims, disputes, damages, or legal actions resulting from the use of the rental item.

6. Cancellations & Refunds

  • A non-refundable deposit is required to confirm the rental reservation.

  • Cancellations made within seven (3) days of the event date will incur a cancellation fee of 50% of the total rental cost.

  • Same-day cancellations or failure to use the rental item after delivery will not be eligible for a refund.

7. Payment & Additional Charges

  • Full payment for the rental must be made prior to the event. Non-payment may result in cancellation of the rental without refund.

  • Any damage-related fees, late pickup charges, or unauthorized modifications will be invoiced to the renter and must be paid promptly.
